Man charged with battery on police

A man is facing one felony charge and two misdemeanors after an incident on July 17 in Chandler.

On July 24, one felony count of battery/assault on a police officer, one misdemeanor count of obstructing an officer and one misdemeanor count of public intoxication were filed against Jack Elton, 19, by District Attorney Adam Panter, according to court documents.

Elton’s initial appearance in court is scheduled for Aug. 13.

According to the prob- able cause affidavit, Chan dler Police Ofc. Kendall Ackerman responded to an underage drinking complaint at Bell Cow Lake Area C. When he arrived at the scene with Ofc. Johnny White, the two observed an individual stumbling toward them from the bathrooms. One of the juveniles at the scene told White that it was her friend.

The report stated that Ofc. White called the individual over, but instead, he got into the back left seat of a PT Cruiser. When White approached the vehicle, he observed the individual pretending to sleep. He yelled at the person to get out of the car, which the person ignored. The doors of the vehicle were locked when Ofc. White attempted to open them. The car belonged to one of the juveniles, who stated that the car was unlocked, but the back door had to be opened from the inside. It was then that the individual opened the door and exited the vehicle, according to the affidavit.

While Ofc.White walked the individual back to the patrol car, the person was stumbling and having dif- ficulty walking and staying upright. It was then that he was identified as Elton.

When asked how much he had been drinking, Ofc. Ackerman said he and White observed Elton slurring his speech when he replied that he doesn’t drink alcohol. According to the officer, Elton was also swaying back and forth and stopping himself from falling over.

WhileOfc.Whiteandanother individual attempted to talk to Elton, he talked over them and used an expletive at the individual. It was at this time that Ofc. White handcuffed him and placed him in the front seat of the patrol vehicle, the affidavit said.

Elton asked the officer to wipe his nose, to which Ackerman replied that he would not. In response, Elton attempted to wipe snot on Ackerman’s arm.

The officer pushed Elton's head back and asked him to stop. Ackerman got out a notice of no trespass to fill out and while he was attempting to get Elton’s information off his iPad, Elton attempted to block the screen with his head. He made several attempts at this, according to the report.

At this time, the juvenile who owned the PT Cruiser asked to leave. Ofc.Ackerman agreed, but only if they could search the vehicle. When they did, they found an empty box and bottle caps to Smirnoff Ice, an empty Four Loko can, an unopened Four Loko can and an open bottle of Everclear. The juvenile stated that they belonged to Elton, who was a friend and provided them with alcohol, the report said.

Ackerman transported Elton to the Lincoln County Jail. When they arrived, Detention Officer Landon Jones stated he needed to take Elton’s blood pressure. After,WhiteandAckerman escorted Elton into the jail and told him to sit on the booking bench. He refused, shouted at Ofc. White and then pushed him.

Elton was then booked without any further issue.
