A Jones man wanted on first degree murder charges and the subject of a search by U.S. Marshals was arrested last December on a firearms count in Lincoln County.
Terry Dwayne Shaffer, 42, was formally charged April 21 in Lincoln County District Court with possession of a firearm after former conviction of a felony.
A $10,000 bench warrant was issued the day charges were filed.
He is accused of being in possession of a rifle on Dec. 22, 2020, after having been convicted of a felony, driving under the influence of alcohol, in Oklahoma County in a case filed on Nov. 12, 2013.
According to a probable cause affidavit filed by Lincoln County Deputy James Robinson, he responded to the area of U.S. 177 and 990 Road around 9:30 a.m. on Dec. 22.
Robinson said the call was in reference to a U.S. Marshal trying to locate Shaffer wanted on murder charges.
The deputy said he was advised Shaffer had run into the woods east and north of 900 Road. Robinson stated he and other Sheriff’s Office employees were tasked with perimeter control just north of 900 Road at a residence on the east side of 177.
Robinson said the U.S. Marshal team was tracking through the woods north of the deputies’ location near another home.
Robinson reported that Sergeant Tanner Hand observed the subject near the tree line north of their location. He, Hand, Capt. Chuck Brewer and Undersheriff Tim Donaldson all advanced on the subject’s location ordering him to show his hands.
He said the subject appeared to be carrying a rifle and started walking toward them holding the gun with both hands. Robinson said the subject wasn’t pointing the firearm at them at that point.
“We continued commands for him to drop the gun and put his hands in the air. It appeared the subject was looking down to the ground as he was walking toward us,” Robinson stated in the affidavit.
The deputy said a vehicle came up beside them and then want past them. The subject’s body became obscured from Robinson’s vision and at that point Robinson said he observed the vehicle speed up toward the subject and strike him.
The rifle became separated from him at that point and the subject was taken into custody by the U.S. Marshals.
The Oklahoma Highway Patrol came to investigate the scene after Shaffer was taken to the hospital.
Robinson later obtained the information about the rifle and learned it was a Stephens .22 loaded with 12 rounds. The OHP took possession of the rifle at the scene, the deputy said.
Prosecutors filed supplemental information showing Shaffer has several other prior convictions.
On July 15, 2003, in Oklahoma County District Court, he was convicted of Aggravated Assault and Battery, a misdemeanor and Assault and Battery, also a misdemeanor, and sentenced to 90 days in prison.
On Sep. 16, 2005, he was also convicted in Cleveland County District Court of possession of a sawed-off shotgun, a felony, and sentenced to 10 years in the custody of the Department of Corrections.
In Oklahoma County District Court on April 19, 2021, Shaffer was convicted of Domestic Abuse, a felony. He was handed a four-year prison term for that conviction.
