A Prague man already facing a manslaughter charge and a Shawnee woman have been charged with larceny of a Controlled Dangerous Substance.
Joseph Resin Linnhuber, 19, Prague and Kaylee Joe Gaskill, 18, of Shawnee, were formally charged in Lincoln County District Court on Sep. 28.
Linnhuber was charged March 2 this year with first degree manslaughter and his preliminary hearing in that case is scheduled for Nov. 9, 2023.
On the drug charge, Linnhuber appeared before Special Judge Emily Mueller on Sep. 21 and Sep. 28 and his pre-preliminary hearing is scheduled for Oct. 12.
Judge Mueller has set his bond at $75,000. Gaskill appeared before Judge Mueller Sep. 21, made her initial appearance on Sep. 28. Court records state her pre-preliminary hearing is scheduled for Oct. 12, but a waiver has been filed and her arraignment is set for Oct. 31. Her bond is $3,000.
In the larceny case, Gaskill and Linnhunber are accused on Sep. 19, 2023 of taking and carrying away a stealth of controlled dangerous substance, Adderall, Xanex, and/or Oxycodone that belonged to Mary Johnson and without her consent with the intent to deprive her of it permanently.
In a probable cause affidavit, Lincoln County Sheriff’s Sgt. Larry Stover, Jr., states he was dispatched to 352308 East 1030 Road, Prague in Lincoln County around 8:39 a.m. on Sep. 20 this year.
The call was in reference to the reporting party’s son stealing her medication and being under the influence.
As he arrived and exited his patrol unit, Stover said he made contact with the reporting party, Mary Johnson, who was outside waiting for him to arrive. She informed Stover her son Joseph Linnhuber had borrowed her car the night before.
Johnson explained to Stover that she keeps her medication in the vehicle just in case she needs it while she is out and that her Xanax, Adderall and possibly other medication was missing.
As Stover continued his investigation, he learned that Linnhuber and Gaskill used drugs the night before and Linnhuber admitted he had taken the Adderall from Johnson. He denied taking the Xanax but told Stover he had taken some Oxycodone from his father without his knowledge and given two of them to Gaskill.
Both Linnhuber and Gaskill went to the Prague Hospital to be checked out. Gaskill was taken by her parents and Linnhuber by Johnson.
