A Cromwell man faces one felony and five misdemeanors after crashing his vehicle during a high speed pursuit in Lincoln County.
Formal charges were filed May 24 in Lincoln County District Court against Clayton Eugene Smith, 27.
Associate Judge Sheila Kirk originally set bond for Smith at $5,000. But during his initial appearance on May 24, the judge increased that bond to $10,000 and ordered him to reappear on May 27.
Special Judge Emily Mueller has scheduled a pre-preliminary hearing for Smith at 1:30 p.m. on July 1.
Count 1 against Smith, the felony, accuses him of endangering others while eluding/attempting to elude police officers by increasing his speed in an attempt to avoid Officers Shawn Stewart from the Sac and Fox Police Department, Stroud Officers Wade Martin and Cameron Stubblefield and Lincoln County Deputy Christopher Hyde, having received red light and sirens from multiple police vehicles while endangering the public with his reckless driving on State Highways 66 and 99 and 7th Street in Stroud in Lincoln County on May 14 this year.
Count 2 charges Smith with driving while under the influence of alcohol by operating a motor vehicle on those three public roadways.
In Count 3, Smith is accused of obstructing an officer by refusing to peacefully allow Deputy Hyde to place him in handcuffs and refusing to give his name, thus delaying the deputy in the performance of his official duties on that same date.
Count 4 alleges he made an unsafe lane change by unsafely and erratically changing lanes on both SH 66 and SH 99.
In Count 5 he is charged with failure to obey traffic control device by failing to stop at a red light at the intersection of SH 66 and SH 99 in Stroud.
And in Count 6, Smith is charged with driving without a valid driver’s license by operating a motor vehicle on public roadways while his driver’s license was expired.
Prosecutors also filed supplemental information in the case showing that on Oct. 17, 2013, Smith was convicted in Okfuskee County District Court on two counts. Count 1 was lewd or indecent propositions or Acts to a child under 16 and sentenced to 19 years in the custody of the Department of Corrections.
On Count 2, he was convicted of lewd or indecent propositions or Acts to a child and sentenced to six years in the custody of DOC.
