Felony charges in assault on officer

A Harrah man was arrested recently by a Lincoln County deputy and Wellston police officer and now is facing three felony charges.

James Nathan Fox, 40, was formally charged in Lincoln County District Court on Sep. 24 with attempted first degree robbery and two counts of assault and battery upon a police officer.

He was arrested following an incident on SH 102 near the intersection of 980 Road in Lincoln County.

Associate District Judge Sheila Kirk set bond at $4,000. Fox made his initial appearance on Sep. 27 and was ordered to reappear at 1:30 p.m. on Nov. 4.

In the attempted first degree robbery charge, Fox is accused on Sep. 18, near the intersection of SH 102 and 980 Road in Lincoln County, of attempting to take an AT&T truck that was in the possession of Jesus Sandoval against his will by force and fear. The charge states he forcibly grabbed Sandoval and pulled him out of the truck, then getting into it and attempting to drive the truck away.

Fox failed in his attempt because Sandoval had removed the keys from the ignition, the charge further reads.

One of the assault and battery on a police officer counts states Fox, on that same date and same location, threw an ice chest at Lincoln County Deputy Sheriff George Kelly Coleman, causing the ice chest to strike the deputy without justifiable or excusable cause.

The other assault and battery charge against Fox accuses him on that same date and location of striking Wellston Officer Todd Beesley on the face, head and body with his hands and fists without justifiable or excusable cause.

In a probable cause affidavit, Coleman stated he arrested Fox shortly after 2:40 p.m. that day after responding to calls of people being waved down on SH 102 between 970 and 980 Roads.

As he was responding, the deputy asked for a Wellston police officer to assist after he was notified a second person also had called.

Officer Todd Beesley arrived before Coleman and advised the deputy he had a suspect at gunpoint who was trying to take over an AT&T truck.

Coleman said when he arrived, Beesley was giving orders to Fox who sitting in the driver’s seat waving his hands erratically and yelling.

The deputy reported Fox continued yelling and waving his hands around. “James would not comply,” Coleman stated, after he had been ordered out of the truck.

Coleman deployed his taser more than once.

Following a struggle with both Coleman and Beesley, Fox was finally handcuffed.
