A man is facing two felony and one misdeamnor charges after an incident that occurred on or about Sept. 6, according to court documents.
Danny Ray Stafford (alias Danny Ray Barnes) made his initial appearance on Sept. 13 and will return to Lincoln County Court on Nov. 19 for a pre-preliminary hearing. On Sept. 15, he was charged with one felony count of child endangerment by driving under the influence, one felony county of driving a motor vehicle under the influence of alcohol — aggravated, and one misdemeanor count of transporting an open container of intoxicating beverage, according to court filings.
In the probable cause affidavit, Trooper Tygart wrote he was dispatched to a two-vehicle collision at E 840 Road and S 3580 Road in Stroud on Sept. 6. He reported that while continuing with the investigation, he observed an adult male in blue shorts, cowboy boots and no shirt standing at the back of his patrol unit. He approached the man, who began asking him about the custodial legalities between him and his wife with their children. Tygart stated that during this exchange, he observed the man slurring and swaying. He asked for the man’s identification, and the man said it was in his vehicle with this three children. They walked back to the car and Tygart said he observed him stumble. He then gave Tygart his ID and the man was identified as Stafford, according to the report.
Tygartreportedthat Stafford said he “needed to call somebody,” which raised more concern about his ability to safely operate a motor vehicle.
The trooper asked Stafford if he had anything to drink and was told “two beers.” Tygart questioned Stafford, asking him about the open container in the center console of his vehicle, to which Stafford responded that he should have thrown it out and it was just there.
Tygart then asked Stafford to perform a standardized field sobriety test, to which he agreed. Tygart reported that the test indicated Stafford was intoxicated. An intoxilyzer test was laterperformed and found that Stafford had a BaC of 0.12, according to the probable cause affidavit.
He was then transported to the Lincoln County Jail where he was booked without incident.
